Cedar haven ranch rider liability release

(Read carefully prior to signing below)

In consideration of being allowed to participate in any way in horsemanship instruction provided by Cedar Haven Ranch, LLC, of 8803 North Cedar Fort Circle, Eagle Mountain, UT 84005, LR Horsemanship of 14245 South 6200 West
Herriman, UT, 84096, Cedar Haven Obstacle Course Arabian Meadows / Sterling Gardner of 10211 N 600 W St. Highland, UT 84003, all their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, it’s related events and activities (including but not restricted to practice on my own), I the undersigned, acknowledge, appreciate and agree that:

1. The risk of injury to me and/or participant, my horse(s), and others invited by me to take part in the activities involved in this program may be significant, including the potential for permanent paralysis or death. This risk includes but is not limited to being in the presence of, mounted on and/or leading horses.
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my presence and participation.
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant concern regarding my readiness to participate and/or the program itself, I will remove myself and my horse(s) from participation and bring such concern to the attention of the Instructor and/or the facility (barn) owner immediately.
4. I, for myself and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE the Cedar Haven Ranch, LLC, LR Horsemanship, Arabian Meadows / Sterling Gardner, its officers, officials, agents and/or employees, other participants, sponsors, and, if applicable, owners and lessors of premises used to conduct the lessons/event (the Releases), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, loss or damage to person or property incident to my involvement or participation in these lessons, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASES OR OTHERWISE, to the fullest extent permitted by law.
5. I, for myself and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releases from any and all liabilities incident to my involvement or participation in these lessons, EVEN IF ARISING FROM THE NEGLIGENCE to the fullest extent permitted by law.

By signing this document, I hereby acknowledge on behalf of myself and/or participant that I recognize the inherent risks involved in riding and working with horses including but not limited to:

  • Bites, kicks, abrasions or contusions from horses.

  • Being thrown or bucked off by horses.

  • Scratches or other injury from stalls or enclosures.

  • Scratches or other injury from grooming tools and other equine equipment and tack.

  • Allergic reactions to animals, hay, or other allergens.

  • Tripping in holes or on materials or equipment.

  • Slipping, falling, or otherwise being injured in the barn, in stalls, or on the grounds, which can be slippery, muddy, wet, or contain or present other hazards.

SOCIAL MEDIA CONSENT

By signing this document, I authorize Cedar Haven Ranch, LLC, to use photos of myself/child on their website and social media.

CANCELLATION POLICY

If a student cancels a lesson (and it’s within a 24 hour window), our instructors do their best to offer a makeup with either them or a substitute instructor. If the offered makeup time doesn’t work for the student, unfortunately the student misses that lesson and it isn’t refunded per our tuition policy. Holiday closures are also non-refundable. This is because some months, students get 5 lessons in the month, and we do not charge an additional fee which balances out occasional missed lessons/holiday closures.

If an instructor has to cancel a lesson, they do their best to offer a makeup lesson either with themselves or a substitute instructor. If no one is available, then a refund is given for that canceled lesson.

FACILITY EXPECTATIONS:

  • Pick up any manure, hoof trimmings, shedding hair, hay, shavings, etc. on property. This includes the indoor arena, outdoor arena, driveways, tacking stations, and aisle-ways around the paddocks.

  • Empty manure buckets if they are full. Manure buckets live on the south-side outside the barn & south side outside the indoor arena.

  • Clear the arena of any jumps, standards, barrels, or equipment into the south-west and north-east corners after use. This ensures it can be dragged/watered each day.

  • Park cars on the west side of the property, passing in-between the barn and the arena.

  • If there is ice, please be careful walking around the property!

  • During winter, hoses in the barn can freeze. Use the red heated hose plugged into the wall. Don’t coil it / leave any kinks in it. To store, let it fall the way it naturally wants to fall inside the big black bucket. If any kinks are in it, it will break the electrical wires. Finally, disconnect red heated hose from spigot after use each time, but you may leave it plugged into the wall.


EMERGENCY MEDICAL CONSENT (to be invoked in the event that your Emergency Contact cannot be reached) by signing this document, I give consent for emergency medical treatment/aid (including x-rays, surgery, hospitalization, medication, and any treatment procedure deemed "life saving" by the physician in the event of illness or injury while on the property or in attendance to a CEDAR HAVEN RANCH off site activity. By signing this document, I will not seek reimbursement from CEDAR HAVEN RANCH or its employees, representatives, or agents of CEDAR HAVEN RANCH for any related charges or fees.

AUTHORIZATION FOR EMERGENCY MEDICAL TREATMENT

In the event emergency medical aid/treatment is required due to illness or injury while being on the property or in attendance to a CEDAR HAVEN RANCH off site activity, I sign this document to authorize CEDAR HAVEN RANCH to:

1. Secure and retain medical treatment and transportation, if needed.

2. Release records upon request to the authorized individual or agency involved in the medical emergency treatment.

UNDER UTAH LAW, AN EQUINE ACTIVITY SPONSOR OR PROFESSIONAL SHALL NOT BE LIABLE FOR ANY INJURY TO, OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISK OF EQUINE ACTIVITIES (CODE OF UTAH 78-27b-101 & NV REV STAT 41.519).

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. BY SIGNING THIS AGREEMENT, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING OR USE OF THE OWNER'S HORSE AND/OR PARTICIPATION IN ANY AND ALL ACTIVITIES AT, OR WITH A REPRESENTATIVE OF, CEDAR HAVEN RANCH, LLC INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF YOU OR CEDAR HAVEN RANCH, LLC. READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANDING OF AND AGREEMENT TO IT'S TERMS.
